The central question addressed by McLachlan (law, Victoria U. of Wellington, New Zealand) in this treatise is what rules or principles properly govern the cases where exercises of adjudicatory authority in different jurisdicions over aspects of the same, or closely related, disputes run into conflict with each other, a longstanding controversy of law. Separate chapters address conflicts between national courts across borders, conflicts between arbitrational tribunals and between such tribunals and national courts in commercial arbitration and in mixed investment arbitration between states and foreign investors, and conflicts between tribunals adjudicating disputes on the plane of public international law and between such tribunals and national courts. A final chapter explores the implications of the previous discussions for the wider system of international litigation and assesses recent proposals for reform.
