Hasnas (McDonough School of Business, Georgetown U.) argues that in the context of the federal standard for corporate criminal responsibility, the requirements of federal statutes used to combat white-collar crime, and the incentives created by the US Sentencing Commission's Federal Sentencing Guidelines for Organizations, there often arise conflicts between compliance with the law and ethical behavior. After examining substantive and procedural innovations introduced into federal criminal law in order to police business activity, he discusses how these innovations lead to ethical dilemmas in the areas of organizational justice, respect for employee privacy, maintenance of confidentiality, organizational trust, and ethical self-assessment.
