This volume of the Encyclopedia of Law and Economics, edited by Sanchirico (U. of Pennsylvania Law School), contains 17 articles addressing key issues of litigation, procedure, and evidence from an economics perspective. Core issues addressed include pre-trial bargaining, the incentives that arise from varying rules for allocating the cost of litigation among parties, the social utility of private lawsuit incentives, and the ways that out of court settlements differ from those cases that are fully litigated. A number of the articles on such core issues have been updated in light of recent research and new articles on recent issues have been added, the bulk of which concern the nature and design of judicial fact finding.
